Court grants bail to rape accused after victim claims love

New Delhi, Jul 21 (PTI) A Delhi court today granted bail to a youth, accused of raping a girl, after noting the victim had stated that she wanted to marry him and refused to undergo the medical examination. "As per the medico-legal certificate, the victim and her parents had refused to get the medical examination of the victim. In her statement under Section 164 of the CrPC (before a magistrate), there is no allegation of sexual intercourse," Additional Sessions Judge Vinod Kumar said. The court granted relief to Sanjay alias Sahil allowing his plea for bail on furnishing a personal and a surety bond of Rs 20,000 each. Sanjay, 22, was arrested on April nine after a case was registered with Burari police station here on a complaint of the victim''s father that he had kidnapped the girl and sexually assaulted her at a rented accommodation for a week. Sanjay Kumar and Vineet Jain, counsel for the accused sought bail for him on the ground that the victim did not level LEVraise any allegation against him and had even refused undergo medical examination. They also claimed the victim was in love with the accused and wanted to marry him. Public Prosecutor, on the other hand, submitted that the victim had in her statement before the police specifically stated that she had lived with the accused as his wife. The court, however, relied upon the victim''s statement made before a magistrate in which she denied the charges against the accused. Sanjay''s case was taken up by social activist Sanjay Sachdeva who has launched a helpline service in the name of ''Love Commando'' to provide all sorts of help to love birds. PTI ATP.
